Marketplace Withdrawal Notice for Digital Content

This notice supplements the Marketplace Terms. It applies as a precaution for the exceptional case that, despite the business-only Marketplace, a contract is formed with a consumer.
1. Scope
- The Synclaro Marketplace is available only to businesses acting in the course of their trade, profession, or commercial activity, public-law entities, and public-law special funds. Business customers have no statutory right of withdrawal.
- If, in an individual case, a contract is nevertheless formed with a consumer, the following instructions on withdrawal apply to that contract.
- This notice covers contracts for the supply of digital content that is not delivered on a tangible medium.
- This notice does not create a contractual right of withdrawal for business customers and does not change the buyer restriction in section 1 of the Marketplace Terms.
2. Instructions on withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Synclaro IT Dienstleistungen, proprietor Marco Heer, Bahnhofstraße 15, 92318 Neumarkt i.d.OPf., Germany, telephone: +49 160 99471052, email: marcoheer@synclaro.de) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
3. Expiry of the right of withdrawal on immediate delivery
For a contract for the supply of digital content not delivered on a tangible medium, the right of withdrawal also expires under section 356(5) of the German Civil Code (BGB) once we have begun performing the contract after you
- expressly consented to us beginning performance of the contract before the withdrawal period expires,
- confirmed your knowledge that, by giving that consent, you lose your right of withdrawal once performance of the contract begins, and
- we have provided you with a confirmation of the contract in accordance with section 312f BGB.
You give this consent and confirmation during checkout through the declaration on immediate digital delivery. We provide the confirmation of the contract, including your consent and your acknowledgement, with the order confirmation by email on a durable medium before delivery begins.
